Madras High Court Orders Only Sports Persons Can Be Office Bearers In Sports Associations; Mandates Online Registration For Sports Meets
The Madras High Court on Wednesday passed a large number of mandates to guarantee a superior structure for the working of sports associations in Tamil Nadu [S Nithya v. The Secretary to the Union of India The Ministry of Youth Affairs and Sports].
Justice R Mahadevan made it compulsory for sports associations to enroll with the State government, set up grievance redressal cells, and effectuate an online registration framework for every single athletic title.
The single-judge in his request said that these actions would “go far in guaranteeing that the best talent in the nation is sent for participation in each occasion that is important to the degree of Olympics and that meriting competitors are never avoided about the fight.”
Relevantly, the Court coordinated that significant functionaries in such associations would just be sportspeople, and nobody would be given a significant post just on the ground of monetary commitments.
This request came on a petition by an athlete looking for an online enrollment framework, asserting that disregarding her heavenly execution, she was denied entry by the Tamil Nadu Athletics Association to partake in the Open National Championships for the years 2017 and 2018.
The petitioner presented that the respondents take on a single-out strategy to choose competitors while overlooking very much justified athletes like her.
Indeed, it was the candidate’s conflict that there was a critical need to execute the Sports Code to patch up the State and District level sports bodies and recover them from “the grasp of legislators or finance managers”.

On the issue of whether the Association was manageable to write jurisdiction, the response of the Court was unmistakable and reverberating “yes”.
To arrive at this resolution, the judgment in Board of Control for Cricket in India v. Cricket Association of Bihar was examined where it was seen that, “any association or entity that has such inescapable command over the sports and its issues and such powers as can make dreams end up in smoke or work out can’t be supposed to embrace any private movement”.
Along these lines, the accompanying mandates were passed:
- The State government ought to consider making a legitimate system that forces legal guidelines on the working of each sports association/clubs/affiliation, including the state unit of the National Sports Federation about each field of sports;
- Each sports affiliation/association will be mandatorily enrolled with the State government;
- Each sports Association ought to have a record of all the above-expressed details and it will be inside the force of the State government to review such records at some random point of time;
- The State government just as the state unit of the National Sports Federation of each sport which is perceived by the Central government will have a grievance cell;
- The positions of President, Vice President and Secretary of each sports affiliation/association just as significant functionaries of such associations including that of the State unit of the National Sports Federation will be held simply by sportspeople;
- The selection of athletes will be inside the domain of the dynamic powers of the selection board comprising just of sportspeople;
- No individual will be qualified to hold the position of President, Vice President, Secretary or some other significant functionary in any relationship just as alliance on the main ground that the person has contributed monetarily to the said association;
- Any reference to the term ‘sports persons’ would mean an individual who has taken an interest in sports basically at the State level;
- An online registration framework for all district level, state level, and national level athletic titles, competitions, meets and occasions, like the model, continued in the Federation Cup Athletics Championships, will be effectuated right away;
- It will be required for each association to have a site where all its monetary guide as endorsed and conceded by the sports development authority of the individual State just as by the Union Government should be outfitted;
- In situations where it is found after an enquiry that any affiliation/association or state unit of the National Sports Federation has acted against merit about the choice of members, the State Government can make a correctional move against such an association;
- In case of any complaint made by any athlete/sports individual to the state unit of the National Sports Federation, the equivalent will be discarded inside within a week from the date on which such a complaint has been raised;
- The ideas put forth by the 6th respondent, which are separated in para 9(vi) of this order will be considered by respondents 1, 4, and 5.
With these bearings, the petition was discarded.
